2. Purposes and Legal Bases
- Master data (name, address, contact information, date of birth):
Contract initiation and performance pursuant to Art. 6(1)(b) GDPR
and proof of age pursuant to Art. 6(1)(c) GDPR in conjunction with § 8 JuSchG.
- Health data (allergies, medical conditions, pregnancy,
medications): explicit consent pursuant to Art. 9(2)(a)
GDPR for risk assessment.
- Photo consent (optional): consent pursuant to Art. 6(1)
(a) of the GDPR; for recognizable persons, additionally Art. 9(2)
(a) of the GDPR.
- Documentation of consent: legitimate interest pursuant to
Art. 6(1)(f) of the GDPR (verifiability pursuant to Art. 7(1) of the GDPR).
3. Recipients
The data is processed exclusively internally and transmitted electronically to
the studio mailbox. No transfer to third countries takes
place, provided the provider used is located within the EU/EEA.
4. Retention Period
- Master data and consent documents: statutory retention periods
(typically 10 years for supporting documents pursuant to § 147 AO; warranty and
statutes of limitations for torts).
- Health data: retention for the same period to preserve evidence in
the event of liability.
- Photo consents: until revoked, followed by deletion of the
underlying data, provided there is no retention obligation.

6. Obligation to Provide Data
The provision of personal and health data is required
to ensure the tattoo can be performed safely. Without this data,
the contract cannot be concluded. Consent for photography is voluntary.
7. Automated Decision-Making
No automated decision-making or profiling takes
place.
